Terms of service
These general terms and conditions (“Terms”) govern the business relationship between Wako GmbH (“we”, “us”) and our customers in connection with ce:koon prosthetic covers, configuration services and related offerings, unless expressly agreed otherwise.
1. Scope
(1) These Terms apply to consumers and businesses unless mandatory law provides otherwise.
(2) We do not accept conflicting or deviating customer terms unless we have expressly agreed to them in writing.
2. Formation of contract
(1) Information on this website and in the online configurator is non-binding unless expressly marked as binding.
(2) A contract is formed when we confirm your order in text form or when we deliver or perform, whichever occurs first.
3. Customisation & medical notice
(1) Covers are manufactured according to customer specifications. The details entered in the configurator and our confirmed technical specifications are decisive.
(2) Our products do not replace medical advice. Coordination with treating orthopaedic professionals remains the customer’s responsibility.
4. Prices and payment
The prices stated at the time of order confirmation apply, plus applicable taxes and shipping costs unless agreed otherwise.
5. Delivery
Delivery times are estimates unless a fixed date has been expressly promised. Force majeure and other unforeseeable events may justify a reasonable extension.
6. Warranty
Statutory warranty rights apply. Claims for defects are governed by applicable law.
7. Liability
(1) We have unlimited liability for intent and gross negligence and for injury to life, body or health.
(2) In cases of slight negligence we are liable only for breach of material contractual duties; liability is limited to foreseeable, typical damage.
(3) These limitations do not apply to claims under product liability law.
8. Retention of title
Delivered goods remain our property until all claims arising from the business relationship have been paid in full.
9. Final provisions
(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If you are a merchant, the place of jurisdiction is Linz, Austria, where permitted by law.
(3) Should individual provisions be invalid, the remaining provisions remain in effect.
